Application for Transfer of a Premises Licence

If you wish to take over a premises licence, you must make an application to transfer it and also obtain consent from the existing licence holder. A premises licence can only be transferred to a party who would be in a position to use the premises for licensable activities authorised by the premises licence.

The relevant transfer application form can be found on the bottom of this webpage. The completed application must be submitted to the Licensing Authority with the relevant fee of £23.00 and the premises licence. If the applicant is unable to forward the premises licence, then they must give written reasons why this is not possible. A copy of the transfer application must also be sent to Lincolnshire Police's Licensing Team. Contact details are on the application form below.

Licence transfer applications (regarding the sale of alcohol and/or the provision of late night refreshment) must also be copied to the Home Office (Immigration Enforcement Section) at: Alcohol Licensing Team, Home Office (Immigration Enforcement Section), Lunar House, 40 Wellesley Road, Croydon, CR9 2BY (Email: alcohol@homeoffice.gsi.gov.uk)

The Police and Home Office then have 14 days to object to the proposed transfer of the licence. The Police and Home Office will only object if they are of the opinion that granting the transfer would undermine the crime prevention licensing objective.

Any objection by Lincolnshire Police or Home Office would result in the application being heard by the Council's Licensing Act 2003 Sub-Committee (consisting of Councillors).

Where no objection is made to an application the Licensing Authority must grant the application to transfer the licence (unless there are specific reasons why it must not do so).

Right to Work in the UK

All individuals (including individuals within a business partnership), who apply for a premises licence transfer authorising the sale of alcohol and/or the provision of late night refreshment, must prove that they have the legal right to work in the UK.

Each individual applicant must provide copies of official documents showing that they are either a British or UK citizen, a national of an EEA country or Switzerland, have been granted indefinite leave to remain and work in the UK, or have another immigration permission allowing them to lawfully work in a field relevant to the sale of alcohol and/or late night refreshment.

Premises licences cannot legally be granted to any person who does not have the right to work in the UK.
