Application to Vary a Designated Premises Supervisor

The holder of a premises licence may apply to vary the person named as the Designated Premises Supervisor (DPS) on the licence.

The relevant application form, which can be found at the bottom of this webpage, must be submitted to the Licensing Authority with the relevant fee of £23.00. The consent form part of the application must be completed by the proposed DPS to show they agree to being a DPS. A copy of the application must also be sent to Lincolnshire Police and notified to the current DPS (if there is one).

The Police then have 14 days to object to the proposed variation of the DPS. The Police will only object if they are of the opinion that granting the variation would undermine the crime prevention licensing objective.

Any objection by Lincolnshire Police would result in the application being heard by the Council's Licensing Act 2003 Sub-Committee (consisting of Councillors). Where no objection is made to an application the Licensing Authority must grant the application to vary the DPS.

NOTE: The statutory application form to vary a premises licence to specify an individual as DPS asks the licensee to give a copy of the form to the existing premises supervisor. However, the completed form contains personal information about the proposed new DPS and sharing this information would be in breach of the Data Protection Act 1998. It is sufficient for the licensee to inform the DPS that the application has been made, without the need to share the specific details of the application. A full copy of the application form must still be sent to Police. The form will be amended via Regulations as soon as possible to make this clear.
