What we do with your data
Your privacy is very important. East Lindsey District Council is the Data Controller responsible for the personal information you may provide in relation to the investigation and enforcement of anti-social behaviour.
Why we need your personal data
Your information will be used to investigate anti-social behaviour. The legal basis for processing your data is Article 6(e) of the General Data Protection Regulations. The Anti-Social Behaviour, Crime and Policing Act 2014, Anti-Social Behaviour Act 2003, Police and Criminal Justice Act 2001, Violent Crime Reduction Act 2006, and the Crime and Disorder Act 1998 all provide the council with the power to investigate and prosecute offences of anti-social behaviour.
How your data is used
When taking a report, the following details will be asked for:
- your name
- your address
- contact details
- details of your complaint and how it affects you
- any vulnerabilities you may have
- notes about any relevant circumstances that you have told us about
- details of other occupants in your home
It may be necessary in some cases for us to share your information with our partners to ensure that your case is dealt with in the most appropriate way. Where information is shared, it is done in accordance with our Information Sharing Agreements, which ensures that your information is shared, stored and deleted in accordance with the legal requirements. Our partners include Lincolnshire Police, Lincolnshire County Council (for example Children's Services), Registered Social Landlords, and Lincolnshire Partnership Foundation Trust. We engage in multi-agency meetings such as Anti-Social Behaviour Risk Assessment Conferences (ASBRAC), and ASB Case Review meetings (formerly known as the Community Trigger).
How long the information is kept for
Information will be kept for a period of six years from the last contact made on your case unless legal action has been taken through to the courts when data would then be held for 10 years.
Where information is collected about you as a potential antagonist, in respect of other people's complaints you will be made aware if we open a case, and if action including any markers are placed on your record. These markers will be reviewed annually to ensure they are accurate and current.
