Application for Transfer of a Gambling Premises Licence
If you wish to take over a gambling premises licence, you must make an application to transfer it and also obtain consent from the existing premises licence holder.
Any qualifying person may apply to the Licensing Authority for the transfer of a gambling premises licence. It is important to note however that the person submitting the application for transfer must:
- hold an operating licence from the Gambling Commission (which authorises them to carry on the gambling activity in respect of which the premises licence is sought), or
- have made an application, which has not yet been determined (for an operating licence which authorises them to carry on the activity in respect of which the premises licence is sought).
The relevant transfer application form must be submitted to the Licensing Authority with the relevant application fee and the original premises licence. If the applicant is unable to forward the premises licence, then they must give written reasons why this is not possible.
A separate transfer application form must be submitted in respect of each individual premise for which a transfer is being sort. The application for transfer must:
- specify the time when the transfer is to take effect,
- be accompanied by a written statement by the current licensee consenting to the transfer*,
- be accompanied by a scaled plan of the premises, and
- be notified to all the Responsible Authorities.
*Only the current licence holder can give consent to transfer a premises licence. Not all listed business owners have to sign the transfer consent. The form can be completed in the company name and signed by a person who has significant control over the business such as director or manager.
You must be over 18 to apply for the transfer of a licence.
What Happens Next
There is a 28-day representation period from the date you apply. After this has ended if there have not been any representations from Responsible Authorities or relevant persons, then we will grant the licence transfer. We will issue the updated licence shortly thereafter.
If there is a representation from a Responsible Authority or other relevant party, then the Council's Licensing Committee will need to look at your application. We will normally arrange a licensing hearing within 20 working days from the representation period end date.
