Application to Vary a Gambling Premises Licence

You can apply to make changes to your gambling premises licence, for example, to add, amend or remove conditions, to change the permitted hours or change the layout of the premises.

The variation application form must be submitted to the Licensing Authority with the relevant application fee and the original premises licence. If the applicant is unable to forward the premises licence, then they must give written reasons why this is not possible. The variation application fee depends on the type of premises.

The application for variation must:

a) be accompanied by a scaled plan of the premises, and

b) be notified to all the Responsible Authorities.

In addition, the applicant must publish notice of the variation application:

a) in a local newspaper on at least one occasion during the period of ten working days starting with the day after the day on which the application is made to the Licensing Authority; and

b) by displaying a notice on the premises to which the application relates:

1)     in a place at which it can conveniently be read by members of the public from the exterior of the premises;

2)     for a period of no less than 28 consecutive days starting on the day on which the application is made to the Licensing Authority.

The format in which the notice must be published is available from the Licensing Team.

Following submission of the variation application the Responsible Authorities and other relevant parties have 28 days to object to the proposed variation of the licence.

What Happens Next

There is a 28-day representation period from the date you apply.  After this has ended if there have not been any representations from Responsible Authorities or relevant persons, then we will normally grant the licence variation. We will issue the updated licence shortly thereafter.

If there is a representation from a Responsible Authority or other relevant party, then the Council's Licensing Committee will need to look at your variation application. We will normally arrange a licensing hearing within 20 working days from the representation period end date.

PLEASE NOTE: Applicants are advised that any applications to amend default licence conditions will not be dealt with by Council Officers acting under delegated powers. A Licensing Committee hearing will consider such applications.

We are aware that one issue likely to be raised in relation to default conditions is the hours the premises may be open in order to provide gambling or betting facilities (for example a betting premises). This Authority will only exclude default conditions and replace the same with less rigid conditions when there are clear and identifiable reasons for doing so.
