Demolition Control
Section 80 of the Building Act 1984 requires you to give the council notice of any intended demolition work.
When Lincs Building Consultancy receives notification of the intention to demolish a building, it will respond by serving a counter (Section 81) notice, which will set out the requirements that must be complied with during the course of the demolition process.
We always try to issue a counter notice as soon as possible; however you should not start demolition works until you receive the Section 81 Notice from us, or until a period of six weeks has expired.
The demolition control service is provided free of charge and includes the following:
- General advice on the demolition process
- Informing applicants of their obligations
- Processing demolition notices
- Site inspections to ensure the requirements of the counter notice are adhered to.
Note: You must give 6 weeks notice prior to carrying out any demolition works, and failure to give a Section 80 notice is liable to prosecution on summary conviction with a fine not exceeding level 4 (£2500) on the standard scale.
