Residential Park Homes Sites

The Mobile Homes Act 2013 was introduced on 26th May 2013. This legislation is specifically related to Residential Caravans & Park Homes and does not apply to Holiday Caravan Parks.

The majority of Caravan Parks in the East Lindsey District Council area are for Holiday use only. There are a small number of sites however, where you are permitted to live permanently, as Planning Permission and a Site Licence have been granted for permanent residential accommodation.

These Residential Parks are licenced under the Mobile Homes Act 2013.

Below is a table listing of all of the Residential Park Home Sites in East Lindsey where you may live.

If the site you are living on or proposing to live on is not listed here, then the park is for Holiday use only. It does not have Planning Permission to allow permanent residential accommodation and you CANNOT live there. Please note that some holiday parks are allowed to open for 12 months of the year but this does not mean that they are residential as you must have a main address other than your caravan.

Should you wish to purchase a residential caravan or park home, we strongly recommend that you consult a solicitor before signing any agreement and ensure that a full planning history search has been completed to establish that the residential use of the caravan is lawful.

Legislation

The Mobile Homes Act has been brought into use in phases, which are designed to give greater protection to occupiers of Residential Mobile Homes and enables Local Authorities to provide more effective enforcement action where required.

Sections 1 - 7 of the Mobile Homes Act 2013 came into effect on 1st April 2014

Section 1 - gave Local Authorities the ability to introduce fees (both on application and an annual Licence fee);

Section 2 - gave Local Authorities discretion on whether to issue or transfer Site Licences;

Section 3 - appeals to Site Licence Conditions will go to the Residential Property Tribunal instead of the Magistrates Court;

Section 4 - gave Local Authorities the ability to serve a compliance notice where there are one or more breaches of Site Licence Conditions;

Section 5 - gave Local Authorities the ability to carry out works where the Licence holder has failed to do so, this includes the recovery of costs;

Sections 6 & 7 - amend details in relation to appeals, operative periods, recovery of expenses and the Residential Tribunal;

 

Section 8 - Fit & Proper Persons

Section 8 of the Mobile Homes Act relates to Site Owners & Managers being assessed and deemed as "Fit & Proper Persons". For further information please visit our Fit & Proper Person page.

Sections 9 - 12 of the Mobile Homes Act came into effect on 26th May 2013

Section 9 - makes Site Rules express terms of agreement;

Section 10 - removes the requirement for the Site Owner to consent the sale or gift of a mobile home;

Section 11 - changes the way in which a Site Owner can change pitch fees;

Section 12 - amends the protection that occupiers of mobile homes have against eviction or harassment;

Under the Mobile Homes Act 2013, Site Owners must deposit a copy of their Site Rules with us so that we can keep a master copy on record. The Site Owner may set their own Site Rules on Residential Caravan & Park Home Sites. The Council does not enforce these rules, although some rules may be a duplicate of the Site Licence Conditions. The Site Rules are part of the contract between the home owner and Site Owner, and supplement the Mobile Homes Act Agreement.
Section 8 of the Mobile Homes Act 2013 was implemented in Autumn 2021.
A small number of parks in the East Lindsey area have planning permission & a Caravan Site Licence for permanent residential use.
